Bring It On! – August 28, 2023: Trump’s 4th Indictment – Georgia’s Election Interference

On tonight’s edition of Bring It On!, hosts, Clarence Boone and William Hosea, spend the hour with Professor Joseph Hoffman (emeritus) of Indiana University’s Maurer School of Law to help us better understand their legal positions and Trump’s legal entanglements.

Donald Trump’s fourth indictment occurred on August 14th. Fani Willis, district attorney of Fulton County, Georgia, which contains most of Atlanta, indicted Donald Trump on racketeering charges including election interference. The former President turned himself in Thursday night at the Fulton County Jail to be booked on felony charges in connection with efforts to overturn the 2020 presidential election results in Georgia.

It now stands that Donald J. Trump has four indictments and three civil cases. Of the four indictments confronting Donald Trump, the Georgia case is the most inescapable, because it is not a federal crime. Thus, a future President Trump cannot order the Justice Department to drop it or pardon himself. Also, he recently lost his bid to hold this trial in a federal court. Now some claim Trump is ineligible to run for the office of the U.S. President.

The claim is that former President Trump engaged in an insurrection and gave aid and comfort to other individuals who were engaging in such actions. This is well within the confines of Section Three of the 14th Amendment. And so, assuming that the public record to date is accurate, Trump therefore is no longer eligible to seek the office of the President of the United States, or of any other state of the Union. Professor Joseph Hoffman (emeritus) is here to disentangle how this aspect of the U.S. Constitution should be applied and other legal issues facing Donald J. Trump.
